Fair Use Policy
This policy should be read in conjunction with the current version of the terms and conditions of service.
Please read this policy carefully. E-volve Solutions Ltd operates this policy in order to conduct its business in a responsible manner to enable it to provide as uninterrupted and seamless a service to its customers as is reasonably practical.
E-volve Solutions Ltd reserves the right to suspend, restrict or cancel a customers access to any or all services provided by the Company should we decide that the service has been inappropriately used.
E-volve Solutions reserves the right to modify this policy at any time. The current version of this policy will be posted on www.e-volvesolutions.co.uk and it is the customer’s responsibility to ensure their awareness of any changes made to this policy.
1. General Use
- a.The customer shall use the specified service provided under the terms of their contract with e-volve solutions for the purposes of gaining access to the Internet or the services thereon.
- b. The services may not be used to send or receive any material which is offensive, abusive, indecent, obscene or menacing; or in breach or confidence, copyright, privacy or any other rights, or to knowingly send or receive any material, including computer viruses or pornography, which transgresses any laws of the United Kingdom, whether Civil or Criminal.
2. Usage
- Business & Home Packages e-volve FUP calculates the average normal usage per calendar month is between 10GB and 1TB. e-fibre Business packages are not included in the FUP and are subject to standard T&C’s.
- Bursting All packages speeds are up to the maximum speed of your package and are based on the peak burst speed up to your maximum rate using a wired connection. If you consistently hit the burst limit then your speed will reduce by 50%, until your burst average drops then the burst will kick back in.
Bursting is in place to give the best possible browsing speeds at all times, each time you request a page, this is less than a few milliseconds, so your browsing speed is always the maximum speed of your package. If you start a large download or stream, this will start off at the maximum speed and then be reduced to a lower burst rate.
- LTE/4G Services these services are carried over a third-party network and all home services have 1TB total FUP.
- Hotspot e-volve calculates the average normal usage per calendar month is 7GB to 20GB.
- Unlimited Internet e-volve operates a fair use policy on unlimited internet. In rare cases, e-volve may find a customer to be using the Internet resources to such an extent that they may jeopardize Internet performance for other customers. In this instance, e-volve reserves the right to suspend or restrict the user’s service immediately and/or require them to upgrade to a higher service. This is only in extreme cases and is intended to prevent excessive use of the resources.
3. Network
- a. The user may not intercept or monitor network traffic
- b. The user may not attempt, establish, or facilitate unauthorized access to the network, resources, or machines without prior consent of the lawful owner of that machine, resource, or network.
4. Email
- a. Using the Services to transmit unsolicited bulk email is prohibited. Activities that have the effect of facilitating unsolicited bulk email whether that email is commercial in nature are also prohibited. The precise definition of ‘bulk’ is at the sole discretion of e-volve Solutions. Recipients must always be provided with the means by which they can easily remove themselves from mailing lists should they no longer wish to receive further information.
- b. Using e-volve to engage in activities that violate the terms of service of any other Internet or online service provider is prohibited.
- c. Falsifying address information or otherwise modifying headers to conceal the senders/ recipient’s identity, for the purpose of circumventing these terms and conditions, is strictly prohibited.
5. Access
- a. Users will not share the username, other than in their own home, business, boat or hotspot.
- b. Login details are only to be used by the owner of the login details and must not be shared are resold; i.e. not letting a neighbouring boat or house share a package or splitting the cost. E-volve monitor the network and if a user is found to be sharing or reselling then e-volve will take legal action.
